Information GatheringThis process continues through all stages of litigation from the very beginning, through negotiation, settlement and/or trial and post-trial. With our clients’ help, we gather and investigate facts and documentation relevant to the legal action. We identify whom are the main witnesses and collateral witnesses. We interview those witnesses and record their statements. Sometimes we hire the help of investigators or experts. Prior to beginning a lawsuit, we gather information related to limitation periods, the law and procedural requirements. Procedural requirements might include when and to whom notice must be served, what conditions (also known as “conditions precedent”), if any, must be met before a lawsuit can be started, and what would be the best way to start a lawsuit. This information gathering and review of laws will occur at every step and is a key part of providing good legal counsel. The more familiar a lawyer is with a problem, the better he or she can solve it in a way most beneficial to the client. |
